Welcome to www.marisolaparlour.com (the “Website”). The Website is hosted on the Shopify eCommerce (www.shopify.com) platform.  Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. Please refer to the shopify.com privacy policy accessible here for further details.

Marisola Parlour (legal name, Marisola Parlour LTD) is a company registered in England and Wales with company number 12987240.

By accessing or using the Website, you approve that you have read, understood, and agree to be bound by these Terms (the "Terms" or "Terms and Conditions"). Please carefully read the following Terms  because they constitute a binding agreement between a visitor (“you”) and Marisola Parlour LTD (“us”, “our” or “we”).

These Terms set the conditions under which you may use our website and the services offered by us. By accessing or registering on the Website or purchasing a product, you indicate your acceptance to these Terms. If you do not agree with any or all the Terms and Conditions, you should not access the Website or use any of its services.

This Website is here for you to review and purchase products that we offer for sale online. Upon completing your order online, Marisola Parlour LTD will review your order and acknowledge receipt with an e-mail message that will be sent to your e-mail address. Please note that an e-mail notification does not constitute an acceptance of your order. Only when you receive a second confirmation email, and your credit card has been charged will your order be confirmed.

 

  1. What are the requirements to create an account?

To use our website and/or receive our services, you must be at least 18 years of age. You are not allowed to use this Website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

Each registration is for a single user only. We do not permit you to share your username or password with any other person nor with multiple users.

When buying an item, you agree that you have read the full item listing and acknowledge that you enter into a legally binding contract to purchase an item when you complete the check-out payment process.

2.Our Service

2.1       Payment and Ordering

All major credit cards are accepted as shown on the website payment page. Payment for all Products must be made by credit or debit card and those accepted by us are those listed on our Website on the date when your order is placed. We will send you an invoice upon receipt of payment.

The prices we charge for using our services / for our products are listed on the website. At any time and in our sole discretion, we may change the prices and availability of any item in our menu and reserve the right to correct pricing errors that may inadvertently occur. Any changes in prices will take effect immediately after being posted on the Website. However, changes will not affect orders in respect of which we have already sent you an invoice.

Our prices include VAT but exclude delivery costs, unless otherwise stated, which will be added to the total amount due before completion of your order and can be checked when processing an order.

Your order constitutes an offer to us to buy a Product. After placing an order, you will receive an email from us. This email is an Order Notification to inform you that we have received your order. A second email will be sent when an order has been accepted and will be accompanied by an invoice.

2.2       Products

All products are made to order and dispatched once a week. Orders received throughout the week are processed at 9am on Monday mornings. Our brownie boxes and letterbox treats are baked fresh and dispatched on Tuesday/Wednesday. Our cakes and cupcakes are baked fresh and hand delivered on Friday and Saturday. Please note that if orders are received after 9am on Mondays, they will be dispatched the following week. 

We reserve the right to use photos of your products for marketing purposes on our Website and social media accounts. The photos will not be personally identifiable to an individual.

 

2.3       Allergen Information

All are products are made using plant-based ingredients and are vegan friendly. In addition, all products are made using gluten free and wheat free flours. However, please check the ingredients list of each product before purchasing. The full list of ingredients of each product is available on the website on the specific product’s web page as well as the information label attached to the product box.  It provides key information of any allergens that may be present.

Please be aware that we handle wheat/gluten, eggs, diary and nut based ingredients within our kitchen and despite every effort made to reduce the risk of cross-contamination we cannot guarantee that traces will not be found in our Products. Please check with the recipient of the product that this would be a suitable option for them before placing an order. Please be aware that we do not accept any liability for any damage to health or any distress caused to you by the consumption of such Products. 2.4         Cake care

The Products ordered will remain fresh for a further 24 hours from the time of delivery if kept by you at an ambient temperature in the box provided. Products placed in a fridge or a freezer or kept for a time longer than 24 hours are so kept at your own risk and we are not liable for any deterioration of the Products in these circumstances.

2.5         Delivery

We currently offer our brownie boxes, treats and gifts for nationwide delivery across mainland UK. Our cupcakes and celebration cakes are available for delivery within certain postcodes in London and Essex. It is your responsibility to ensure that the correct delivery details are provided, including the correct delivery address and contact number and that it falls within our delivery radius. 

When an order has been processed, you will receive a confirmation email and a tracking number if a tracked delivery service has been used. Delivery costs are paid in addition to the cost of the Product. Details of costs are available on the product page.

Our delivery radius is currently the following postcodes in Barking and Dagenham, Havering and Redbridge:

IG1, IG2, IG3, IG4, IG5, IG6, IG7, IG11

RM1, RM2, RM3, RM4, RM5, RM6, RM7, RM8, RM9, RM10, RM11, RM12

If you would like delivery outside of these areas please get in touch for more details.

If no one is present at the delivery address when our drivers arrive, we will try and make contact on the number provided to see if we can deliver to somewhere else or leave with a neighbour. Please note that if we have to redeliver the order, it will be at your own cost and under these circumstances your order will not be re-baked unless you wish to pay for it.

 

2.5.1     Liability

For postal orders, once the order has been handed to the courier company, Marisola Parlour LTD will no longer be liable for it. Where products are hand delivered, they will be at your risk from the time we deliver them to you. We will have no liability to you for any indirect loss. 

2.6         Returns and refunds policy

We hope you’re delighted with your purchase. However, if there’s an issue with your order—such as it arriving damaged or not as expected—please contact us within 24 hours of delivery at contact@marisolaparlour.com. Be sure to include your order number and clear photographs, and we’ll do our best to resolve the issue promptly.

As our baked goods are made to order and perishable, we are unable to accept returns or offer refunds for change of mind. For non-perishable items, such as our hot drink blends, returns may be accepted if the item is unopened and returned within 14 days of delivery. Please contact us to arrange this. Return postage costs are the responsibility of the customer unless the item is faulty.

Should you need to cancel or amend an order, please email us as soon as possible. While we can’t guarantee changes once an order has been confirmed, we’ll always do our best to accommodate.

Refunds are issued to the original payment method and processed within 5 to 7 working days.

Please note: We kindly ask that all order-related queries are directed to our email rather than social media. You’ll be redirected to our website for support.

2.7      Products

Pictures provided on our website of Products are illustrative only. All Products are handmade to order using natural and fresh ingredients therefore products deliver may differ slightly from those pictured. Taste is very personal and subjective so we cannot accept the return of any Products merely because you do not like the taste. But of course, we hope that you will think our products are simply delicious.

The provisions of this clause do not affect your statutory rights.

 

2.8         Discounts

Please note, discounts do not apply to delivery or merchandise items, unless stated otherwise. 

3.General 

The Terms and Conditions constitute the entire agreement between you and Marisola Parlour LTD with respect to the use of the Website and the services therein. No waiver, concession, extension, representation, alteration, addition or derogation from the Terms by Marisola Parlour LTD, or pursuant to the Terms, will be effective unless consented to explicitly and executed in writing by Marisola Parlour LTD's authorised representative.

 

3.1         Misuse of the Site

You will only use the Website for the purposes referred to in this Policy and not access the Website or use information gathered from it to, including but not limited to, sending unsolicited emails, providing false or misleading information or email, transmit or otherwise make available any information or material which may be deemed threatening, abusive, harassing, defamatory, libellous, vulgar, obscene or racially, ethnically or otherwise objectionable.

 

3.2         Right to suspend or cancel user account

We reserve the right to permanently or temporarily suspend or terminate your access to the Site or parts of it if and without notice and liability for any reason including if at our sole discretion we believe you are in breach of any provision of this Agreement. If your access has been suspended or terminated you will not be permitted to re-register or to re-access the Site without our prior consent.

You may discontinue use and request to cancel your account and/or any services at any time.

3.3         Right to change and modify Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these pages periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the Website or the service.

 

3.4         Promotional emails and content

You agree to occasionally receive promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). 4. Indemnity

You agree to indemnify and hold Marisola Parlour LTD harmless from any demands, loss, liability, claims or expenses (including solicitor’s or attorneys’ fees and court fees), made against them by any third party due to, or arising out of, or in connection with your use of the Website or any of the services offered on the Website) and you agree to reimburse us on demand for any losses, costs or expenses we incur as a result thereof.

5. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Marisola Parlour LTD, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.To the maximum extent permitted by applicable law, Marisola Parlour LTD assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

 

6. Ownership of intellectual property, copyrights and logos

The Website and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Marisola Parlour LTD. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
